Commenting on the notice obligations applicable during probation, Mohamed Elmasry, Senior Associate at Alsuwaidi & Company, clarified that employees who resign before completing their probation period are still required to provide notice to their employer in accordance with the UAE Labour Law.
“Under Article 9 of Federal Decree-Law No. 33 of 2021, an employee who resigns during probation to leave the UAE must provide at least 14 days’ written notice. Where the employee intends to join another employer within the UAE, a minimum of 30 days’ written notice must be given. The notice requirement is not waived simply because the employee remains within the probation period,” Elmasry explained.
Addressing resignations submitted shortly before the end of probation, Elmasry further noted that the determining factor is the date on which the resignation is submitted.
“If an employee resigns one or two days before the probation period expires, the resignation is still considered to have been made during probation. Accordingly, the statutory notice requirements applicable to probationary employees will continue to apply,” he said.
