Rajiv Suri, Senior Associate at Alsuwaidi & Company, recently contributed his insights to Asia IP in its article, “Reviving a Dead Trademark”, which examines how trademarks can lose legal protection and the considerations businesses should take into account when seeking to revive or use such marks.
Commenting on the UAE position, Rajiv highlights two risks that trademark owners can sometimes overlook: failure to renew a registration within the prescribed period and the possibility of a trademark becoming generic.
While renewal may appear to be a straightforward administrative requirement, failure to renew on time can result in the loss of statutory protection. Rajiv also notes that successful brands can face a different challenge when a trademark becomes so widely associated with a category of goods that it begins to be perceived as the generic name for those goods.
His comments highlight the importance of treating trademark protection as an ongoing process, requiring timely renewals, regular monitoring and active brand management.
